Somebody has to witness these tests for chain of custody. Why not a medical assistant? It's less expensive than having a physician or RN do so. To answer your question, yes, it's legal.
 
There are places where they don't stand right in the restroom but if they do, it is certainly legal.
 
It is to make sure the test subject does not have a bladder full of another's urine on their person to keep temp correct and release into test cup.
