College Collection

I've received a letter from a collection agency that I owe $1,300 to a college I've attended 18 years ago. Only $600 of this amount is principal - the rest is interest.

College is located in Westchester, NY.

Is there some kind of statue of limitation for this sort of debt?

It depends on where a lawsuit would be filed and on what it would be based. I assume it is based on a contract.

If the suit would be filed in New York (if you are living in New York) and so far no suit has ever been filed on this matter the statutory limitation is six years.

However, if they already sued you and have a judgment against you the statutory limitation to enforce this judgment is 20 years.


From what I assume what you are saying they have never sued you before, so the six years have passed and they are barred from bringing a suit in this matter.

But this all depends on the details of the matter, so this cannot be legal advice but just a general information about the statute of limitations.
