Facts
At at fault defendant negotiated the policy limits , so plaintiff lawyer could move on to UIM from Plaintiffs insurer with stacked coverage
It was later discovered that plaintiff also had 2nd policy from a different insurer offering significant UIM limits for being named as the driver and insured for that policy, as well as the original policy that the auto accident occurred
It's pointed out that insurer #2 unstacked as their feature accepted, . But only 1 vehicle was listed on the bike policy
What plays out in this situation ?
The 2nd insurer was not party to policy limits agreed by both Both primary insurers as the bike policy was discovered to exist by accident at a much later date
Would the 2nd insurer get a "credit" or would they be excluded because they weren't party to orinal negotiations
Can the UIM be collected from both insurers in this situation ?
