NyC: My brother need some help in understanding USA laws related to probation: he has gotton conditional discharge with 1 year probation, he completed his probation successfully. He is on the work permit in USA and applied Green Card application thru his wife.
Question: Is probation a sentence for immigration purposes?
is he going to have any problem in getting green card? His charge was public mischief( petty offence, max. sentece is six months in canada).
He applied thru immigraion attorny still his attorny is unable to explain him about the probation i.e. is probation considered a sentence for immigration purposes? I read your response alraedy about CMT charges, exception of maximum one year sentence. is one year probation period a sentence?
