I deposited check at my bank for the sum of $4970.80, within 3 days, I went into the bank and spoke to one of the tellers to find out if the check had cleared and if the funds were available. I was told yes by the bank clerk. I with withdrew $3200 of the funds and left. One week later, I called the automated bank service to verify what my new available balance was, only to find out that I was overdrawn by $3200. Am I legally responsible to pay the bank back for giving me the money? After all they did tell me that the check deposited had cleared. I know the company that wrote me the check is responsible for making me overdrawn, however, shouldn't the bank take some responsibility for allowing me to withdraw the funds. I have to go into the bank within the next day or two to straighten this mess out. What should I do? I'm on a fixed income and cannot magically create $3200 to put back into my account. Anyone, please help!!
