Charged for Merchandise Never Delivered

Hi,

I am currently involved in a dispute with a merchant regarding credit card charges for merchandise which was never delivered. I will apologize now for the long winded explanation but necessary to convey the situation.

I placed a credit card order for a remanufactured engine over the phone in September with a local Portland, Or merchant. I was quoted a price of $1495.00 and given a 3 day delivery date. The product was scheduled to be delivered to my mechanics shop to repair a vehicle which I had towed after a major breakdown. The merchant fails to meet the this delivery date then again and again etc.

This scenerio continues for 4 weeks, each time requiring ME to contact the merchant for a status. Ultimately my mechanic informs me that he may have to charge me for storage of the vehicle which has been occupying his service bay unless we are to agree on a short term repair solution.
After contacting the merchant again, he attempts to reschedule yet another "tentative" delivery, I inform the merchant that I am canceling the order due to numerous delays and his inability to manage a delivery schedule.

Although these charges were initially credited on my credit card account, they have now been reversed stating that the merchant has provided a signed sales order which states a "NO REFUND" policy. The dispute specialists now claim the matter is no longer in their hands.

I am now being billed $1595.00 ($100.00 over what I was quoted over the phone) from the merchant and $700.00 from my mechanic who made the necessary short term repairs (bandaid) just to get the vehicle out of his shop and running temporarily until I was able to locate a reputable remanufactured engine merchant.

I have never signed a sales order, informed of a No Refund policy and now being billed for an order which I was FORCED to cancel due to the merchants inability to deliver.

This just can't be right and any advise would be sincerely appreciated. Complaints have been filed w/ the BBB (#10 in 36 months) and Oregon State Attorney General's office.

Would also like to add that merchant has a "100% Satisfaction Guarantee or Money Back" plastered all over their wesite.
