My husband's ex has removed DCSS from collecting child support, we have signed our part of the stipulation that leaves child support amount unchanged, removes DCSS, and ask for wage assignment order to be sent from my husband's employer directly to his ex. Her attorney put in a start date of April 1, 2004 but we did not receive it for signing until march 28 and it was returned to her attorney for their signature on march 30. It has still not been processed by the court and filed. Are we liable to pay her directly or is it legal to wait until everything kicks in (wage assignment, etc.) This is in California. Our attorney did not advise us to pay her directly but that we did not need to do anything? Did not realize there would be large amount of time between DCSS pulling out (which they already did) and the court filing the new wage assignment.
