I just went through an eviction hearing in New York State. I was withholding rent from my landlord because work that he promised to do on the apartment was never done and just last week i had the town building inspector in to back up my claims and he deemed the apartment unliveable. The judge did not take these things into consideration in my opinion and ruled in favor of my landlord that i must pay him the back rent and will not even apply the security deposit to the back rent. can this be appealed because in my readings and interpretation of the laws in New York, a landlord cannot legally charge rent for a dwelling that is uninhabitable?
