My ex is in prison for the rest of his life. He will be 70 in March if he lives that long, he has terminal cancer. I am only 55, we were married 17 years. I am on SSDI, and I have since remarried. My new husband is also on SSDI. When I get retirement age, would I be able to draw off my ex, he made more money that I did?

Husbands and wives are entitled to collect Social Security benefits on their spouse's work and earning records.

It is not as well known that the benefit applies to divorced spouses as long as the spouse has not remarried.

Divorced spouses are even entitled to survivor benefits in certain circumstances.

Most divorced spouses collect their own Social Security while the former-spouse is alive, but can apply for higher widow or widower benefits when the former spouse dies.

This is one of the SS websites:

I suggest you take a look, and when you're ready simply a Social Security representative by calling toll-free at 1-800-772-1213 (TTY 1-800-325-0778) between 8:00 am – 7:00 pm, Monday through Friday.
