My biological father started receiving 100% V.A. disability several years ago, I was just informed of this fact less than a year ago by an uncle. I have not had any contact with him since I was 3, he was extremely abusive to my mother and I, but he put me down on his records as a dependant. I recently applied for educational benefits, was approved and will be receiving them shortly, I am in college. When I asked if I was eligible to receive the back benefits that I was owed the V.A. said no, that it is the veterans responsibility to inform the dependants of their eligibility. My question is do I have a right to the years of back benefits I was never informed I was eliginle for? If so do I need an attorney to represent me?
