Two days away from our possession date, and our lawyer advises us that the vendor's have "lied" about the property tax's on the house by a few hundred dollars. We sent a letter to their lawyer advising them to compensate us, and they have declined, stating they have no idea what their property tax's were and they were not the ones who came up with the number. Are we in a position that we can back out on the deal?

Property taxes are public record.

You will have a hard time proving you didn't know something that you should've found out yourself.

Sure, you can always back out of a deal. Depends how far along you are, if it will benefit you or not.

You can break the deal for fraud alone.

There was no fraud indicated anywhere in the post.

The property tax they listed is what we brought to our bank for Mortgage purposes (property tax's are being bundle with the mortgage), so now that will all be incorrect, resulting in a higher mortgage payment. Our lawyer did do a tax search for us, and that is how he came across the problem. We went by the tax's they listed on there MLS listing.. who supplies the realator with this information, why can't they be accountable for providing false financial information? thank you

Did you read the part of the listing stating that they are not guaranteeing the accuracy of someone else's figures?

Yep...they're not liable (as you can now see).
