I am having a problem with my neighbor who has a campfire and the smoke comes directly in my house. I have called the local fire department numerous times to no avail. My city does allow campfires however this neighbor abuses the permit and burns garbage and other yard waste which is not allowed. Also they are breaking 3 of the regulations according to the city campfire laws. I am curious if it is possible to take them to court under tort of nuisance and hopefully get an injunction filed to stop the burning. If so what process would I need to follow?
