I received a dwi (my first ticket of any kind in 30 yrs) , and and a civil revocation of my drivers license. I appealed to the dmv for a hearing. The hearing officer ruled against me. (fox guarding the hen house) By statute , I had a right to file an action de novo in civil superior court within 30 days. I went to the clerk of superior court 2 weeks later and asked for the form on which to file . The clerk of court said, "I've been here fifteen years and never heard of it." She made a phone call and came back to say," yes you do have that right, but you can not file it here end of conversation". Four days later the dmv sent for my license. I complied. What recourse do i have? Is my driver license the property of the state or my property?
