My Husband's parents had obtained their permanent status in the US and were green card holders. They came to the US two times for a year at a time and then they went back to India. This last time they went back to India they did not come back in the two year maximum allowed for them to be away from the US. They had to go back for their daughter who is older, but ill.
Their daughter now has gotten her visa to come to America and now the parents want to come back to the US too. Can they reapply under their permanent status and provide the reason why they overstayed in India or should they apply for a visitor visa. They are old and ill themselves and we want to do what we can to bring them here the fastest?
