Boundary Line Wall

My neighbor dug under our Boundary Line Fence. His insurance company states that he is liable, but will only pay me half the money to repair the fence. They say paying me 50% makes me 100% complete. I think they are going to pay the neighbor the other 50%, but I am not sure. Am I entitled to more money from the insurance company to make the repairs? The neighbor and I can not agree on the builder for the wall. The wall has to be built to code and he just wants to find someone cheap. the wall fell because he found someone cheap to do some work. I really do not want to get into a legal battle with the neighbor. Is the insurance company quoting the Law correctly to me?
