Board not following Deed

What recourse does a unit owner in a condominium have when the Board is not complying with various aspects of the Master Deed? Decisions not made a public meetings, membership not allowed to vote on anything at annual meetings, financial records are not being disclosed, proxies not allowed to be used at annual meetings nor are the proxies validated, etc.

I know- vote them out but no one wants to get involved in such a mess now. Having a court order them to comply would be nice but no one has the money to spend on this. Is there anything like a "small claims" court for something like this that does not involve a monetary claim?

Can you give us an idea as to what is happening -- are you saying that you aren't receiving financials at all? If this is the case, the affected owners may want to begin by writing a letter, certified return receipt requested, setting forth all of these violations. If this doesn't work then getting an attorney's letter may not be a bad idea either -- it may be worth it to get a consultation from an attorney in addition to the warning shot to those committing the infractions.

Unfortunately there is a case near our building where the condo board is being hauled into court... sometimes it does get messy but this is a good starting point.
