Does one have to be present at their bankruptcy hearing? My relative is out of the country...he is a permanent resident of the country and I would like to file bankruptcy for him. Will he have to come the states at any point during the process? Can I represent him?

Thanks in advance.

My understanding is that the actual person filing bankruptcy needs to make an appearance. The debtor needs to address questions under oath. On a related note, I don't think it would impress the court that the debtor, who wishes relief from the court and creditors who may be present, doesn't even bother to show.
