Involved in auto accident in which neither party had auto insurance at the time. Can the party that hit the other one be held accountable for the damage sustained to car via small claims court or would it be considered a mute point. I really need to get my car fixed back the way it was and the person that hit me admitted it was their fault the accident happened. Also reported to police that they were insured at time and were not. What can I do. I need my car fixed.
 
You have to sue them in small claims. If you need your car fixed now, then you'll have to front the money to get it fixed then sue in small claims to recover it. This is also your fault since you also did not have insurance. If you had insurance you would not be in this mess.
