I was just involved in a car accident a few days ago. The breaks on my car failed causing me to go threw the stop sign and get hit by another. No one was injured on either side of the accident. I received two tickets since they could not prove that my breaks really failed. One was for careless driving and one for failure to stop. Total the fines are $170 and 4 points. We have a document stating that the car was taken in a few months earlier to get the breaks checked because the same thing happened before, but the mechanics said it should be fine. We had planned to argue that since the car had previous complaints of break failure that there might be the possibility that my statement could be accurate to at least get a reduced penalty. Now the case got transfered to the prosecutors office and from what i've been told that usually means larger fines and penalties as well as more court costs. Does anyone have any advice to help against the county prosecutor?
