at fault driver hasnt filled claim

on july 8th i was t-boned.in snohomish washington. wasnt my fault have police report and everything. its been a month and they still havnt filled a claim. i got a lawyer but he seems like hes to busy to help me. i cannot get my car fixed until i get a claim. is there some kind of time frame for that? it was by a big car lot company, a employee hit me in a employer vehicle while he was on the clock. my left side of my car is badly damaged and needs to be fixed soon the passenger door will not shut all the way. ive had to go to the doctors several times and had to pay out of pocket for all of this. i need any advice i just got the car 10 months ago, and have gap insurance but dont understand how it works. i also need to go to physical therapy but cant because i have no claim number..what can i do?
