a friends of my child and her friend rented a old attached apartment.
She moved in and discovered that one of the bedroom ceiling
under the light fixture was broken and pieces of the asbestos
was hanging down.
AC working minimal in two bedroom and kitchen.
living room is the only room functional.
They came the next day to cut and smooth the ceiling but
one hour later, opposite side of the ceiling drooped and ceiling is
now it is touching the light bulb. (no precaution was taken to repair the ceiling!!!
This is a one year contract and in the lease agreement,it mentions as follows:
ASBESTOS Residence understand that the property may or may not contain
materials in which asbestes has been used, The asbestos fibers are typically bound together with other materials to form an indestructible package when undistsrubed, but as the bond breaks down due to aging or frequent contact, tiny particles that contain asbestos fibers may be released into the air and inhaled into the lungs or swallowed.
There are no regulations requing the removal of asbestos from residences. Asbestos may be hazardous to your health. After careful consideration, residence has decided to rent this home with understanding the fact that it may contain asbestos and hereby releases the owenre and manger from any liability in connection herewith. No holdes will be put in tothe ceiling and no damges will be caused to the ceiling because this may release asbestos into the air. (asbestos may also be contained to to other parts of the house)
Can they break the contract under this condiiton?
