Advice needed!!

Hi, I need help with a credit card account that has been sent to National Action Financial Services. I owe $12000.00 to Sears. I had problems, couldn't afford their monthly payments they wouldn't work with me. I get a call on Friday that NAFS works for lawyers this is a courtesy call before they fax papers to my county @ 4:00. He wants $8000.00 today or I can pay $1500.00 a mnth for 6 mnths. I tell him I can't do either. I tell him I can pay $122.00 a mnth until I get the $ to pay off. He takes checking infor for six mnths. I told him I would try to get a bank loan but doubted it would go through unsecured. He tells me my new balance will be $9200.00. Called back on Tuesday, I told him the loan didn't go through. He says he has to stop the cks for $122.00 & fill out paperwork to garnish my wages. If I quit they will garnish my husbands. (He is not on the credit card acct) He gets the fax # & sends over a form to be filled out by HR (which is me) for job title, salary, date of hire. He calls back in a few hours, I tell him I am not filling it out. If he doesn't want the $ I can pay then I will have to hire a lawyer if he is going to sue. He calls back & wants the lawyers phone #. I tell him they will be in contact w/ him. The last time this account was paid on Sears owned in one year ago. I am scared & don't know what to do. I can't come up w/ that money that soon! Should I contact a lawyer? Can they garnish mine & my husbands wages or freeze our checking acct.? Please advice me on what to do. I know I owe it, I tried to pay what I could & he backed out!!! Any advice would be greatly appreciated!!

Why would the attorney tell you that they could garnish your husband's wages? Did he sign as a guarantor of some sort? While they might not be able to garnish your husband's wages, they can go after property and bank accounts owned jointly by both of you. At this point you should probably speak to your husband and decide how to deal with going forward. I don't know what your financial situation is but if you are thinking about bankruptcy then you should consider that carefully with your husband as well as with a specialist. Otherwise, this may involve your selling some assets in order to pay off the loan before it becomes even more costly and you are charged for more enforcement charges for collection, freezing accounts, finding assets, etc. I'm sorry but I'm not sure how we can help you with an overdue credit card.
