5 day notice from LL to commence summary proceedings

Since June, we live in a rent stabilized apartment in Brooklyn, NY. Ever since we moved in, we had problems with our apartment - 2 weeks without a sink and countertops in the kitchen, unfinished painting, heat problems, and the worst was,when we found out that we have no floor underneath our feet. The floor literally consist of the floor boards that we are walking on. Whenthey recently happened to move, we could see right into the basement on the floor. After all this stress, and after finding out that the LL has no certificate of occupancy, although major construction took place in the building, we decided to move out. We already had paid up front one month security and the last month rent. We lived out the month rent, and also did not pay rent in Feb. We found a new apartment and will be moving in on 2/15. Today we received by regular mail a letter from our current LL, stating that we would have 5 days to either pay our rent or leave the premises.Otherwise he will commence summary proceedings.

We do not really want to file a lawsuit. Actually we just want to leave this ongoing nightmare? But what can we do in this case? Would he have the right to evict us before we leave anyway? We live here with our granddaughter, who is 3 years old. She was the one, who suffered the most under the dysfunctional heating system. I look forward to your advice.

An eviction would take far longer than 10 days to occur. You could, if you wished, contact local Code Inspection. If your place is as bad as you say, they will likely condemn the place.
