In my divorce, I was to get the 401k and my ex was to get his retirement. The judge messed it up and switched it. I have been waiting a while for them to do something about it, but nothing has been done. I would like to be able to move my money out of the current plan it is in but still waiting for them to fix the mistake. Is there a statute of limitations on this?

You need to petition the court and request any inaccuracies you note get corrected.

No one cares if its wrong or not.

You notice how quiet your former spouse became, right?

You'll probably need a lawyer to get it done correctly.

I'd talk to a couple and find out if its possible.
That initial conversation won't cost you anything but time.

What difference does it make? If it's 4 years, will you wait 4 years? If it's 10 years, will you wait 10 years?

If nobody else cares enough to get it fixed, then it's up to you.

The sooner you do it, the sooner you get control of your 401(k).

Self preservation is nobody's business but your own.
