feb. 2006 wife and i needed help getting 1st caught up and DITECH (2nd). Broker began looking for help and found a HARD MONEY LOAN. The following is how the DEED OF TRUST reads, This Deed of Trust, made this 3rd day of February, 2006, among the Trustor, MY NAME a married man as his sole and separate property (herein "Borrower).... Here is my problem, on date listed my wife and I were both on the title. Feb. 16 I signed papers for the loan. Feb. 17 my wife signed a Quitclaim Deed removing her from the deed on the understanding, "This is the only way New Haven Financial will fund the loan for your home." They have been using the Feb. 3rd date for all docs. they are using to forclose. Is the deed of trust legal? The statement sole and separate was untrue at the date of deed. What if anything can I do? THANK YOU.
