I recently moved to Michigan from Hawaii at the age of 17 due to multiple issues I had there and I was working on establishing some form of residency in Michigan when my mother (who has custody of me) all of a sudden had an issue with me being here and demanded I return immediately. I told her I wouldn't and she involved the Honolulu Police Department who contacted the Warren Police Department. Six Warren Michigan police officers came to pay me a visit and four of them spoke with me. They said as far as they were concerned I was not in trouble and they contacted my mom and told her this situation was more of a family issue. I was also advised to get some form of identification by them (state ID, etc). After that incident my mom told me that a Honolulu Police Department officer wanted to speak to me on the phone. He said he understands the situation from my point of view but he still has to file the paperwork on the situation and I'll have 60-90 days before two HPD officers come to retrieve me and take me back. He also advised that if I want to stay I need to do whatever I need to do immediately when it comes to applying for identification here to make me a resident. My mom told me this morning that three detectives are making this an interstate case and they will come retrieve me in 60-90 days after I've spent 60-90 days in a juvenile or prison facility. Also she is very controlling and manipulative. One of the reasons I left was because she would physically beat me and verbally abuse me when things weren't going her way. I also had much stress and many hours at my job there which was with a university for 14 months. Also I had very bad associates there who encouraged things like underage drinking (most were adults). I forgot to mention earlier in this post that I'm originally from Michigan and I've only been there in Hawaii for 1 year and 11 months. I feel I've done nothing wrong to be arrested for. I'm also concerned that I'll go into cardiac arrest or my heart will not be able to handle the flight if I'm arrested, detained for 60-90 days, or put on a plane if I'm escorted back to Hawaii by police because I already had a very bad ekg test. I have plans for my future here (college, work, socially). What are my legal rights and what can I do to stay here in Michigan?

With due respect to our LEOs, the majority know about jack zip when it comes to family law.

Now, what sort of heart problem do you have? There's a reason I'm asking..

Okay, when will you celebrate your 18th birthday (just month and day), please?

Frankly, at age 17, you allege to have worked at a university for almost a year and a half (14 months)?

Were you 15 years of age working FULL time?

In what country were you born?

Do you possess a birth certificate, or can you obtain one?

At age 17, how many years of education have you completed?

Answer please, and I'll endeavor to assist you.

Relax, things are looking okay for you at the moment.

And perhaps more to the point, how come you can fly TO Michigan...but not FROM Michigan? I'm still questioning your actual condition - and there's a darned good reason for it.

Let me just say, that was one hell of a ride in. I felt pretty horrible once the plane got in the air but at that point there was nothing I could do about it so I just tried my best to cope. I just don't want to go through that again because I'm not sure if my body can tolerate that experience again. That's just one of the many reasons I don't want to go back.

I feel my medical issues may be able to help me legally in some way. That's why I stated my medical result as part of the post. Also I haven't been diagnosed with anything specific yet. Now as for the questions:

Okay, when will you celebrate your 18th birthday (just month and day), please?

Frankly, at age 17, you allege to have worked at a university for almost a year and a half (14 months)?: 14 months point back to October 6th, 2012 if my math is correct meaning I began working at the university at the age of 16. 5 days after I turned 16 to be specific.

Were you 15 years of age working FULL time? 16 years old, and it wasn't full time at first but as time went on it became full time-overtime.

In what country were you born? United States of America, Detroit, Michigan.

Do you possess a birth certificate, or can you obtain one? I have all my important documents and paperwork which includes my birth certificate.

At age 17, how many years of education have you completed? Up to 11th grade, then I took my GED around the beginning of this year after I moved. Before I moved I attended Fraser High School in Fraser, Michigan.

-Thanks for taking time to help me.

I'm not exactly sure. Just had a bad ekg reading which can mean anything. It could range from mild stress to something as serious as aortic stenosis. I just don't want to take chances and increase my heart rate to dangerous levels like I've already done once by flying here.

Believe it or not, an ekg will generally give enough data to either go further in diagnosis and/or testing...

But given that you have no diagnosis, you're not going to be using the "I might have a heart attack" card.

Lets throw out all the things up until now and start fresh. I doubt the city of H is going to spend $10k dragging back a 17 yr old who can legally leave in less than a year. If he had picked somewhere other than the armpit of Warren MI, that statement might change. Once you have been in MI long enough to establish residency you can petition for emancipation if you have all the documents needed. This assumes you have the means to support yourself legally. That does not mean those harboring you will not be charged. You should have chosen Texas a minor is emancipated under some circumstances at 17.

Sorry, but a single bad ekg and having been scared on a rough flight (which is all you've described) does not give you a medical exemption from being sent back to Hawaii or detained in a detention facility or any other consequence of your actions that you might be required to deal with. Your "medical condition" is not going to do jack squat to help you.

What about the physical abuse from my mother?

Agreed. I just thought I should put that out there and be open about everything. Is there anything else that I can use in my defense? For ex the physical abuse dealt by my mother?

Upon doing research I found that I am not being harbored by these individuals as it's stated by michigan law that harboring only applies to a child below the ages of 17 (1-16). And I thought Michigan had the same law that a 17 year old can be emancipated at 17.

The operative word is can. Can is not the same as Will.

In general, physical abuse may be a valid reason to remove you from the home. It is not a basis for emancipation. Particularly in another state.

Now, that said, I do recognize that under MI law, it may be difficult for either your mother or LEO to force you back. But that is not a guarantee that you, and those you are staying with, are guaranteed to be scott free.

Well, you'll be 18 in about 10 months, OP.
At age 17, the state of HI, or the city of Honolulu, won't waste time chasing you, maybe.
You can seek employment, get a hotel room, obtain a valid MI ID, and start living your life; if this s your choice.
Or, return to mommy's house, chill for a few months, turn 18, and do what the 3 Little Pigs did, make your way into the world, but avoid the BIG BAD WOLF.

You're a TWEENER, pal. Stay outta trouble, no one will look twice at you, except the BIG BAD WOLF.

You can spot the BIG BAD WOLF easily, he's got big ears, a big cold nose, very sharp teeth, and often dresses in granny's bed clothing.
