Question about motions and motion like things

Its not a huge amount. A little over $4000. Which is a big deal to us. Even thought we don't have much disposable income, my spouse is a firefighter, we did try to contact a few attorneys and no one was really interested when they heard it wasn't $10,000 or $15,000. :( . You're the first...

Question about motions and motion like things

Backstory: Brought a house, seller signed a contract agreeing to certain repairs, lied that the repairs were completed, we are suing for the funds to get them completed. The clerks at the court house try to help me as much as they can within the limits of what they are allowed to say to me...

Seller didn't complete agreed upon repairsQ

Isn't there some rule about timely resolutions? How can a judge take a case under advisement and just let it linger for seven months?

Seller didn't complete agreed upon repairsQ

Where do I go from here? The judge said she was taking the case under advisement back in November . As of today I have not heard a single word from the courts. Have called I have left messages with the judge's assistant. Nothing. No feedback no follow-ups. And of course I have not heard from my...

Seller didn't complete agreed upon repairsQ

Well I called on Tuesday explained to the clerk that we had already had a trial in early November and that the judge took the case under advisement. I explained that we hadn't heard anything back yet and would like to know what procedures or steps we'd need to take next. I told her about the...

Seller didn't complete agreed upon repairsQ

UPDATE. So the seller came out with her contractor. I had one with me also to make sure there was no funny business. Her contractor saw all the things that weren't done and agreed that they did in fact need to be repaired. He also found a few other things that fell within the parameters of...

Seller didn't complete agreed upon repairsQ

Oh gosh yes I remember that. You followed through or your name was mud with the other kids. I was raised being told all we really had was our good name and that you had to protect that. Shame everyone wasn't raised that way.

Seller didn't complete agreed upon repairsQ

You're correct Army Judge. She gave me a time and date to come and inspect the work. I've asked her to refrain from contacting me until then. I hate this. I only want her to meet her contractual agreements. Contracts should mean something. Thank you all so very much for your valuable...

Seller didn't complete agreed upon repairsQ

Well she's now trying to intimidate and threaten us into taking a small pay out. She says if there is ANY judgement against her she will keep appealing so we better take what's she's offering and sign a paper agreeing that the issue is resolved or else. This woman works in law enforcement.

Seller didn't complete agreed upon repairsQ

Thank you so very much. I guess We'll wait and see what she hands down. I think she believed us and our evidence. she just didn't like that we didn't reach out to the seller to try and resolve it before filing. The way she's acting now is the reason we just went ahead and filed. Thank you...

Seller didn't complete agreed upon repairsQ

Well we didn't subpoena anyone because the facts were pretty heavy on our side. We didn't think the whole thing would take more than an hour. It went on for almost 4. She suggested in court that she essentially paid for all the work in good faith and had no idea it wasn't done. it was...

Seller didn't complete agreed upon repairsQ

The whole process has been confusing. She gave us the forms to dismiss without prejudice and made it clear to the seller we could refile the case if we hit a stalemate.....again.

I don't think I made clear that The judge said she would issue a judgement at the end of the month. She went over all the possible out comes to illustrate we'd all be rolling the dice if we let her. With that said, is a summary judgement still what you'd suggest?
