    Get yourself a lawyer and take it to court. If you can prove without reasonable doubt that she is unfit then the court should award you sole custody. It will be an uphill battle, but it will be worth it. Good luck to you.

    If there is no custody agreement then yes, you can take your child/children out of state. I would double check with an attorney in your area though.
