Other Criminal Procedure Case law affect on Probable Cause

We don't do homework. Your professor wanted you to reason out the possibilities (on both sides of the argument) rather than asking the internet to hand you answers. This is a THOUGHT task not a research one.

California Law / Small Estate Affidavit / Trust

If she titled the property to the trust, then no probate won't likely be necessary. However, an in vivos trust will not stop any claims against the property form debtors of the estate. If the property is sold within a short period (9 months?) of her death, you can just treat the sales price...

    About joint ownership of condo

Note that PUTTING SOMEONE ON THE DEED is not the same as "leaving it to them if you die." Deeding property away is immediately and irrevocably giving them some portion of the property. A joint tenancy can be broken without your consent. There are all sorts of downsides to you and to the...

    SSI income limit?

HE'S LYING. There's no practical way for you to tell when the check clears. The bank will make the funds available to you immediately. The system is optimized on the fact that most checks are good and if they aren't the depositor can be trusted to make it good. It can take weeks for the...

    Please read and HELP!!

Understand you have issues that are only slightly related: 1. The money you owe (and the issues in determining that). 2. Your criminal charges for defying a lawful court order. As you've been told, the time for fighting battle #1 was a long time ago.

    SSI income limit?

You're being scammed. The check is no good. You'll be out the paintings as well as the money you "laundered" to the shipping agent. When it bounces, your bank will demand their $1850 plus a fee (plus additional bounce fees if this allows your check to bounce). NO LEGITIMATE PERSON WOULD...

Burglary, Arson, Home Invasion Arson Questions

In Maryland, the state Fire Marshall's office has statewide investigatory authority. They are a division of the State Police. Many of the county police departments also have Arson Investigation Units. As has been pointed out, there's nothing magic about arson. Depending on the...

Car Towed while out of state—$875

It requires either ticketing the car and waiting 96 hours -or- proper signage -or- that the car was inoperative and reported to law enforcement and 24 hours elapsed. So "without warning" for non-inoperative cars require proper signage, which WAS NOT DONE here.

Car Towed while out of state—$875

Why not? If the requirements of 22658(a) are not met, section (e)(1) states that relief. OK, it's not a crime, it's an infraction under (e)(2) and subject to $1000 fine.

Car Towed while out of state—$875

There was signage but it failed to comply with the rules. 22658.2(A) requires the sign bear the information for the towing company(s) that are authorized to tow. The company that was used for tow was not listed on the sign. The person who authorized the tow, hence, has committed a crime...

Inside academia, Dr. is commonly used for PhD's. In formal social situations, PhDs should eschew being called doctor. I used to get letters from the National Science Foundation that said Dear Dr. Natalie that had the Dr. Natalie crossed off and "Ron" put in there. I'm not a PhD, but I...

Car Towed while out of state—$875

Except that the HOA rules can't trump the state law. In order to authorize a tow, you need to meet one of the requirements listed. 22658.2(a) requires a warning in most cases either a sign with the actual towing companies used, or a written 96 hour notice on the vehicle, or the vehicle has...
