Just because you getting a public defender does not mean not to get consultations I mentioned. In fact it would be wise to do so so you have some knowledge before meeting public defender. By the way why would you get arrested 'again"?!

Yes you should talk to a Lawyer many offer free consultations. When you do ask them about Diversion as possible plea option. I do find it odd you were taken to jail though as its the norm to cite and release for petty theft. What state did this happen in and did you have an ID or criminal history?

A call asking about should not provoke further action in my view

As a general rule when you are banned you get some paperwork. Without it its difficult to file tresspass if you enter store after ban. You should have been told how long ban was for at time but a simple call to store LP should get you that answer

Civil demand has nothing to do with criminal charges

"Assuming" can be dangerous! I am just saying you might be questioned or even charged if the investigation shows you might have had knowledge or played a role in one or more thefts

We have no way of knowing why charges have not been filed. However it is possible they are building a case and will file later. With it being so much over so long it might take some time. Please keep in mind its possible you rname will come up in investigation and you charged as well

The charge itself should be on your citation or court summons. However rather than ask what will I get why not ask what deal you can make. Start calling Attorneys many offer free consultations. When you meet with these lawyers ask them if Diversion is available in your case

Yes store has one year to file criminal charges. Now how soon your contacted will depend on how busy court is and where statute of limitations is at time. I know it not the answer you were looking for for, but I dont want to mislead you either

We cannot say about court papers as stated we dont even know if or when they might file. Far as ban goes if all they said was "store name" without any further statements or store names then just the store name you were accused at should apply

Trying to deal with this without the help of an Attorney would be your second mistake. Many Attorneys offer free consultations get as many as you can. Ask them about diversion as plea option. then if you cannot afford any of them you will have knowledge you can take when you ask for public defender
