No you talk to DA work out deal. Then you go to court and Judge either approves or denies deal you made with DA

I suggest paying civil demand. since you are not being allowed an Attorney you will be forced to deal with DA yourself. Ask DA if you plead "no contest" and pay a fine that your record can remain clear?

There may be a store policy that forbids non security people from making shoplifting stops. This would not prevent contacting Police ro Mall Security though

You could even be IDed and stopped next time you enter mall or that store

Mall security could have got them (you said store staff was on phone) or there might be parking lot or store outside cameras
