Can i take legal action against my employer

Has this time you are missing lately been because a doctor has seen you and taken you off work or do you just not ho in because you are not feeling 100%? Makes a huge difference. Regardless, that is a matter between you and the WC carrier, not employer. If you haven't contacted your employer...

Advice on explaining resignation and then termination

Maybe I'm missing something but I'm not sure why you are so angry. You resigned. They asked you to stay on until they found someone. They found someone and then made your resignation effective as they said they would. Perhaps they could have been more clear about how long they would allow you to...

I had to quit. Do I have a case?

Asking you out is not illegal. Making going out with him a condition of employment would be. Many people meet their spouses at work. Nothing wrong with that. If you on the one hand tell this guy you will go out to dinner with him and will text your address, I'm not sure how you think he should...

Jury awards historic damages for disability discrimination.

Sounds like more of a criminal case than an employment one.

First, there are several things that are not clear. I will need te answers to these questions before I can help. 1. Did you file a WC claim? If yes, was it accepted by the carrier? 2. Have you been off because of the work injury or for some other reason(s)? 3. how long have you worked...

    FMLA/STD+ Vacation

We have a similar policy. As long as the person is on FMLA or getting a paycheck from us, they continue to earn leave. Once they go on unpaid leave, they stop accruing.

    Possible Hire Discrimination

It is also legal not to hire you back in a different role. It is also not an uncommon policy, especially when the reason for ending the previous employment was for cause/initiated by the employer.

txls- I hear you. Of course my own father was one of the offenders! A few years ago before he retired, he had a surgery and was to be out 5 weeks. He returned after 2 because he was bored at home and told his coworkers not to tell me. Someone who didn't usually work in his building visited there...

    Deceptive employment ? Please help

Does going on commission only change how much you can make substantially? If you are expected to make about the same and the only thing that changed is how your salary is figured, it is going to be all but impossible to win any kind of claim. That is totally different than having your job yanked...

That commercial just makes me angry. I don't like when organizations try to play on my sympathies for their own gain. My parents didn't go through a fancy rescue organization, just the local animal shelter. It still cost over $100 for a kitten and they had to go for 3 interviews, including...

Teacher Offered Two Separate Contracts equaling 100% (one with a contingency clause)

Whether they can or not is a matter of state law/regulation and your union contract. In my state, that wouldn't fly. Your mileage may vary.

Teacher Offered Two Separate Contracts equaling 100% (one with a contingency clause)

A lawyer isn't going to be able to help you too much. Your union *might* but only if the way they are handling this violates the contract (union agreement). Tenure is granted by the state so whether these positions qualify you or not is out of your individual districts hands. ho can "bump"...

One of mine came from a pet store but I didn't purchase him, I kind of inherited him. The others were all free. I've never gone to an animal shelter though my parents have. They made it very difficult to adopt a pet. I don't understand that. It would honestly have been cheaper to buy one at a...

I am only vaguely aware there is a sport known as "baseball". Only player I can name is Cal Ripken and he retired some time ago. This weekend I didn't have any munchkins competing but I was helping to run the show anyway. The food went over well. Crockpots were the way to go. We got lucky...

TX- Meatballs in sauce is high on my list of possibles. Making a black bean chili recipe that I have that is really really easy and throwing together a ceasar salad. Figured I should have something for the carnivores among us as well.

Been a helluva week. Been at work since 7 at one of our sites and if I am lucky, I will only put in a 12 hour day. Tomorrow I am helping to run a district debate championship tournament and I am providing all the food for the judges. We have already established that my sanity left me long ago...
