F Visa Student visa after american high school

Hello everyone. My brother came in the US legally as a tourist in 2005 and he attended 4 years of high school with no problems. He graduated this summer. Now, he tried to apply for a community college and they told him that because his I-94 has expired, he can't apply for a student visa. What he would have to do is go back to our country, stay there for a couple of weeks and then come back with the renewed I-94 and apply then. Now, that is not easy. So, I was wondering if the fact that he attended high school here makes a difference. Is there a way he would be able to attend college with his high school background? Thank you for your time! ok so he can attend college as an illegal imigrant, however, he will most likely have to pay more and also once he graduates if he needs to get some sort of lisence it will be nearly or imposible for him to get it. Also keep in mind that if he plans to work here once he graduates he will most likely not find a job as most companies would not hire somebody who is here illegaly.
 
The easiest and safest route is for him to return home and follow the correct procedure. As an illegal, he could easily be deported anyway and made to pay the costs. Furthermore, if deported or convicted or even if found to be an illegal, this could affect his chances of ever being allowed to enter the US again, and may affect his capacity to apply for visas to other countries. Overstaying a visa is an indictable criminal offence and may result in a criminal record.
