Consumer Law, Warranties Afraid to return merchandice for refund. Verbaly abused in email by seller.

I bought a machine on Ebay. The machine was not described correctly. It was the demo release of the machine.

When pointing this out to the seller and asking for a refund I was told no at first. Then, after calling me greedy and a liar, and accusing me of doing something I didn't, they said I could return it.

I'm afraid to send it back to the seller because they are demanding this "open box" item be in immaculate condition. It works perfectly fine minus the wrapping and the instruction manuals being flipped through. I'm also afraid I won't get my refund by the way they handled the situation.


Here is what transpired. All in emails.

Me-

"You sold me a DEMO unit. The manufacture part number is MV-8800D, not MV-8800. You did not include this anywhere in the description of your auction. Why didn't you include in your auction description that this was a demo unit."





Them

"We sold you an open box item at less than MAP. Does not matter if it was demo, noted as open box, no returns. You're simply looking to try to steal a deal. Greed pure and simple.

"First day, we told you if you did not want it, to send it back for refund."

- Not true. Have email to prove it. First day I was told I cannot send it back.

"It became a D, demo problem, when YOU decided that not only should you lowball us on an opened box item, but you should also then try to get more money, gee haven't seen any greed like that since the Republicans.

- I never asked them for any money of any sort.


"As far as you bringing up Bullshit about us not shipping in feedback. You personally know that's not true, you paid, we shipped instantly, so WTF are you talking about?"

- Have yet to leave them feedback on ebay. I never left them feedback.

"Again, it was and is about you being Greedy and wanting more than you deserve, now it's about you wanting to make us look bad, next it will be us looking for dollars for your lies"

- Threatening me



What should I do?
 
File a complaint with eBay immediately. eBay will refund your money even if the seller refuses to refund, and they will be punished. Any sale under fraudulent terms (in this case it's that they implied it was the actual machine and didn't mention it was the demo) is prohibited on eBay. eBay and/or PayPal will finish up the problem for you.
 
Thank you for the timely response. It is much appreciated. I will take your advice an immediately contact ebay.

Had the seller simply said "Ok, no problem, return it."

I wouldn't have a problem returning it. Their actions towards me leave me very skeptical that I would actually receive a refund from them. Before I send anything, I want to make sure I have all my bases covered. Thank you again.

If anyone has anymore advice, it would be greatly appreciated.
