I received a citation for the destruction and removal of plant life within a state park. The boundaries for the state park were not posted and no fence had been erected. I had no idea it was a park. I was there to harvest palmetto berries for pharmaceutical purposes. Upon my first plea appearance I was informed that the charge had been changed to the destruction of public property and in addition another charge of petit theft had been added to the case. Is the state able to change the charge and add additional charges? Also, should I have been informed of my rights at some time during the process?

No . . . a common misconception, reinforced by TV

Your rights (Miranda) are read before undergoing
interrogation, or formal questioning

Thank you very much for your concise/accurate answers to my legal questions. This web site is remarkable. It offers free answers to legal questions. You can bet that I will remember the T L law firm when it comes to hiring legal counsel. I feel that in todays economic turmoil it is difficult to know and understand all the laws. In my case, I will just have to do the time for the crime that was committed. Ignorance of the law is no excuse. Time for me to study more legal issues and try to keep myself out of situations like this. Again, my greatest appreciation to all that reviewed my case.
