I plan to take an online travel company to small claims court because of fraudulent charges but sadly I dont have evidence of the correct charge. The company sent me evidence now that I did initial the charges but a copy was never sent to me at the time of transaction and billing to CC. I dont recall initialing the web page that they sent me recently. Can I argue that the webpage was made after I originally initialed the correct charges? If my case against the travel company fails, I plan to take to court the credit card company. I originally disputed the charge after the travel company refused to give me any resolution. But credit card company rejected the claim for failure to show evidence. But what kind of fraudulent charge would have evidence? How do you produce evidence when the charge was unauthorized?. To dispute a case of fraudulent charge, is evidence critical?

Evidence is always critical to win a suit! In small claims you have the burden of proof. Always print every screen you put your info on, and read and reread the small print. Once you click "OK" you singed an agremant.
You can check your computer history, and print out old pages, and check buyer beware websites for other complaints, for evidence.
