Need to know my chances

My girlfriend and I have a 7 month old son. We get along well, but I am unhappy living with her. I would like to end the relationship but feel like I'm being held hostage by a custody battle. We are both actively involved in the care of our child. I supported the three of us for six months while she stayed at home with our son. Now she has gone back to work, and we have comprable incomes. However, I fear that if we split she will want to take him to California(we live in Utah). She has a few family members ther but the majority of her family lives here. As does mine.

I would like to attain joint legal cutody so I can see my son as often as possible. Would be more than happy to have him reside with me. I can provide a safe, clean and positive living environment. I had two DUI charges form nearly ten years ago. I was told that this would not affect my chances. Other than those two poor choices I am model citizen with a great family.

You definitely have a good chance at joint. Do not let your Gf call the shots. You should see an attorney. You can also put a geographic restriction that she cannot move without your permission.

Was paternity ever established by you signing the birth paperwork?
 
Then you should go to court and file for joint custody. you can also see if you can put a temp. ordr in that neither of you are to leave the state with the child.
 
i know in my order here in va, that the father had put in the order that if i were to move out of the state then I would be responsible for 50% of his cost in coming to visit the said child. 50%. I don't know if that is something that can be added where you are. If they say she can move out of state.Good luck w/ your case.

Going through a child custody battle is never an easy situation...there are many options you can take, in order to obtain joint legal custody of your 7-month-old son...Since you live in Utah, I would definitely consider at least speaking with a Utah child custody attorney to help provide you with the best legal options and advice for you and your son...
 
Actually if she is allowed to move out of state, I would ask that she provide 100% of all transportation and any transportation you are required to do, you want deducted from your child support.
