Buying a trademarked logo?

Hi

I want to trademark my logo to put on tee shirts. Another guy has trademarked a simular logo here in Wisconsin but I don't see it nationaly. I think he has given up on using his logo for bumper stickers and shirts. My question is, I would like to offer to buy his trademarked logo so then there is no conflict when I use mine. How would I go about doing this? What steps should I take? Any information would be greatly appreciated.

Did you do a search on the USPTO web site to see if he filed a federal trademark? Go to http://www.uspto.gov and do a search - try the other guy's name. Just because a logo is similar doesn't mean there is a trademark issue and it's complicated to discuss without seeing a sample. If you want to discuss your purchasing the rights to use the mark from him you can do so - but it may be expensive. If he's abandoned usage, how long has it been? It might not be long enough for the law to recognize that it has been "abandoned" and now you would be free to register the logo as your trademark.
 
Thanks for responding to my question. Far as I can see he has not trademarked his logo with the USPTO, Only in Wisconsin. I would show you both logo's, But I don't want to post on the board. Thanks for your advice on this issue.

I did a search at the office of secretary of state here in Wisconsin and he registerd his logo ther.

I did a search through th US trademark search and found nothing.
