Insurance company won't respond.

I was wondering if anyone can give me some advice regarding dealing with the insurance company of the driver who rear-ended me. My lawyer sent a demand letter to the insurance adjuster 60 days ago and they have yet to give any kind of response. After voiceing concerns to my lawyer a few times, he finally sent a reminder letter to them about a week ago. If there is still no response in another couple weeks is there any steps I can take or ask my lawyer to do (he's not very aggressive on my behalf)? I dont know if there is a set time limit by law on auto accident settlements. Right now it seems as if their approach is, "If I ignore it long enough, it will go away."
Also, towards the beginning the adjuster had asked about any other past injuries to my back/neck. I have had scoliosis since I was a kid and I told my lawyers aide about it. She thinks they can use that against me. I have soft tissue damage to my trapezius (?) muscle and the pain after the accident is nowhere near related to the discomfort I feel due to the scoliosis. Is this something they can use to lower my settlement amount or not give me a settlement at all? Thank you to anyone who can help.
 
Getting paid for a soft tissue injury, especially where there is already a prior problem, is always tough. It doesn't sound like you have much of a case which explains your atorney's attitude. It is not unusual for these things to take up to two years.

You are correct in the approach the insurance company takes.
 
Thank you for your response. I didn't realize things would take so long on such a low amount when they already their driver at fault. All we are asking for is reimbursement on medical bills and time missed from work due to the accident. Shouldn't I be entitled to that?
 
You should but that costs them money. Usually if it is a small amount you are better off suing them yourself in small claims. Don't forget to check your state to see if you can get dimunition of value on you vehicle unless you have already signed a release.

Some companies are worse than others. I have had trouble in similar instances with State Farm and Viking. They figure that enough people will give up and go away and they are right.
