My current fiance has not been with his ex in over two years, yet she is still harrassing him. Basically, 1. they bought a house together, but it was only in her name 2. she opened a line of credit (also only in her name) with Hewlett Packard a few years ago and let him build a very expensive custom computer. When he left her, he only took bare necessities with him: the computer(with all of his information on it, none of hers) and his clothes. In order to appease her and in hopes of recovering many of his things that he didn't get to leave with, he paid her mortgage and most if not all of the bills for months after he moved out. He quit paying the mortgage and utilities and such, but continued to pay on the computer, until recently. He has been trying to negotiate a time to come back to the house and reclaim items belonging to him for quite some time now. She just decided in the last week that she is going to hold the items hostage until he either transfers the balance for the computer into his name or pays off the balance, which is still almost $1,200. After discussing the situation together, we decided that whatever he might be able to recover from her would probably be damaged or far from the condition he left it in and therefore no longer worth the fight, so he gave up on trying to get his stuff back and in turn quit paying the HP bill. Now she is threatening us with small claims court. How can she even suggest that he should be forced to pay a debt that is solely in her name??? Also, since she wants to fight about something, he wants to make it worth her while. So he is preparing documentation showing the mortgage that he paid from the time they closed until about 6 months after he left (just about a year total) and all of the things that she kept of his (including some things that belonged to his parents!) and many other receipts to try to recover some of his investment in a house that she kept and will eventually profit largely from. (The house was not in any condition to be lived in when they bought it. His father helped him completely redo plumbing, structural and other areas that had serious damage.) Do we have a case? Or does she?
