Dear Sirs:

In Montana, a child can testify at 13, there are exceptions, my son testified at 10.

The child cannot chose, but can influence the courts decision. If your child has been living in Florida for more than six months with the other parent, you will have to follow Florida law.

That deosn't mean that the court would go with what the child wants. IT can go either way. It worked in my case, but each case is different.

If you live out of state, it is going to be hard to get custody switched.

Some courts will listen to the child at age 13 or so, but you still have to prove a change of custody is in the courts best interest.

I never recommend making a young child testify and putting them in the middle of this mess.
