Just wondering if you have all been either suspended or banned from ebay while this goes on.

No i have'nt been banned or suspended but will not be using it again to sell anything,not worth the hassle
 
nah im still active on ebay for now. .what did they say about insight to what there after kn95?

does anyone think or know if ebay is giving w.morris details of transactions bought and sold off our accounts, so then they may already know how many have been sold?

Am new to all this,have been reading thoughts since letter arrival....

I have sold one pair on Ebay & kept the other & am wondering as to what I can do about this letter from William Morris. I was chucked off Ebay before able to sell the other pair for trademark violation, now realise that this is how they got my details.

I stupidly bought through a car boot hoping to make a bit of money, have since registered other pair which are genuine, hence unsure as to why they think the Ghd's I was selling were not!

Blimey hope this makes sense and would appreciate any advice.

W.morris have told me they were informed by Jemella of how many i sold, i think they go off how many purchases were made ie:if you listed a batch of 10 and 8 purchases were made.

Only problem here is when the listing got removed not all the buyers paid because of the email from ebay. so really the info they have could be wrong.

I find that odd that ebay ban/suspend you after only removing 1 of your listings, and very odd that you get letter after selling only 1 pair.

Thats a new one on me.

Best just to read right through this thread and keep an eye on it see how people get on

We could do with someone on here who has gone through the same thing we are now going through ot let us know the end result.

My letter is as follows in part as the first two large paragraphs are to be scary about selling counterfeit Ghds.

"prior to receipt of this warning letter, you might not have appreciated the prevalence of counterfeit irons and health and safety risks associated with the selling of such items. Accordingly Jemella is minded not to take action against you on this occasion provided that you address our client's concerns and inform us of (i) the serial numbers of the irons in your possession: (ii) the full name & address of the person who supplied you with the irons: and (iii) the number & date of such supply."

The worst thing is I have been liasing with Vero @ GHD about this since mid February, this letter is dated 29/02/08, only received yesterday.

I have replied via email with what I know, ie the serial number of other irons, & that I am liasing with GHD via Vero, and can they not speak to them about this.

Will await their reply.

Also I think that GHD/Jemella are violating everyone who is selling ghd's in order to get details and send them letters like this, hence being chucked off with only 2 sale items on Ebay.

Hello all, We are in the same boat and it seems (acording to walker morris)
we have sold x amount, and the only way they could have got that figure is if ebay have given it to them, the guy I spoke to which I think you all have, seems ok, he say's all the right things like "were not monsters, we will be fair" and "you can even pay in installments" now to me, that doesnt sound like someone who has a rock solid case for compensation against you.
any more info on the proceeding would be of great help.
 
hi all, ive now got this all sorted and finished. My advice give them what they are after and it will all be done in 2 weeks like mine, i will say it didnt cost that much either. Goodluck to you all kn95

I have received the same letter everyone else seems to have, looking through the forum it does not seem that anyone has put their case to rest. Has anyone sorted their case with walker morris yet?. I see that KN95 has and thats good but does anyone out there have any details of what happens and the best way to deal with the situation. so far all i have done is reply to my initial letter via e mail stating my situation that i purchased the items in good faith, sold them in good faith asking them to view the situation from my side (me being a victim of my supplier) but all i have had is a blunt reply via e mail telling me to call them to sort it out where as some have mentioned i spoke to a Chris who demands all information i.e invoices, supplier details, my profit etc. They also claim to know how many i have sold too (does anyone know if they actually do or are they leading you into a trap?, a friend of mine is a police officer and he says that only the police should be able to gain entry to your e bay details not a private organisation/individual). I get the impression from other posts on here from people who have got legal advice it is not a good idea to sign the documents that walker morris send to you.

Any help from people who have put their cases to sleep would be greatly appreciated

I too have received a letter from Walker Morris. They basically want £350 from me. Has anyone paid this or had any success on not paying it? I have not seeked Legal advice but may choose to if no one else has.
 
In response to other questions they cannot obtain information from eBay or Paypal without a court injunction etc. They more then likely had it reported to them either by someone trying to register a product or by someone reporting it to trading standards. It would be against Data Protection act for eBay to give our details out without asking our permission or notifying us of this. Also I would like to insist no one gives any details about how many they sold or any invoices as you will most likely have to refund the buyer and compensate GHD. Can someone please give me an update on their situation.
 
Just received this from a client

i am writing with regards to the GHD straightener which i purchased from yourself they were for my wife's birthday on the 20th february and after 3 uses they stopped working so she contacted GHD directly who informed her that they were indeed fake and advised us to request a full refund from yourself they also advised us that if we received no satisfaction from yourself then we were to pass GHD your details directly and they would be in contact with you I would also advise you to seek compensation from whoever you purchased the straighteners from
 
Yes the £350 they want looks like it is to cover the start of their investigation and also signing that letter they sent out looks as if it gives them the right to hang you out to dry. I have noted that on here anyone who has had legal advice says that their solicitor has said not to sign that document. It may be a good idea if a few of us get legal advice on the matter first

When you got your letter or if you spoke to them did they tell you they had a record of the number of the items you sold as they did claim to know the figure i has sold

That is not the case bud i though exactly the same, I signed it they had me down for selling 16 and my total cost was not much above the £350

This is where GHD are getting the info from and not ebay, they also are getting the info about how many you sold off watching the listings you were putting on ebay and seeing how many purchases were made.

Dead simple

But, how to get that figure down, by saying that all the buyers did not pay because when they got the listing removed email off ebay they chose not to pay as something wasnt right - you get my meaning

Ok so you got the final figure down by stating that x amount did not pay, so many refunds etc and returned items aswell. Maybe they might just be looking at our feedback scores?
 
Print off all the paypal refund slips and send them along with the letter and these are knocked off the total sold
