mafioso, i was just posting because it was interesting. now i look at the law as I want to learn more about. I got all you said :) I can say you are my teacher.

I actually learn and believe I found the truth about how expungement or all other similar law work in different countries works in different country. if you want, we can share :)

Then hire a lawyer, who will never get that record expunged. If you really knew how simple it all is, you would be insulted by some of the responses here.

I think you hate lawyer too much... their job is to expunge it... how can thye not get it expunged?
 
Does anyone come back after their visa cases pass or fail??? what are the result?
what happened to them?
if they went back home with a criminal record, what would happen to them...
they would not be able to find a good job. is that the end to them?
 
how do I get a F B I record like Criminal History Record or Rap Sheet?
I was not fingerprinted... will they not have my record.. do they get a small misdemeanor like mine?
 
The FBI's website has information on how to order your rap sheet. Just go to the site and follow the instructions. They would require you to send your fingerprints. If you were not fingerprinted your name might still show up if your county's law considers your petty offense a local or one relevant to share….Some counties or local regions don't share some petit crimes especially those which don't need fingerprinting… You might be lucky. But the absence of fingerprints in some cases does not mean they don't have a record. They run your names, DOB, DL number and many details in the system to see if anything shows. Most offenses which don't require arrest and jail are generally infractions like a speeding ticket. But I can't say with certainty how your county treats its own cases. I know of a member of this site who got a ticket misdemeanor destruction of county property (she wrote her name on a rock in a public park. Check my threads about 3 months ago…she was on HIB) but she was not fingerprinted. A month or two later, she mailed me saying her record keeps coming clean. So you might be okay. Just check, some counties act differently from others so I can't tell with certainty
 
If i sent my fingerprints to FBI, would that alarm them to check me even though i had nothing on there now?

what would the lawyer be expunging if there is nothing in FBI? would that make them to put the record back in and expunge it?

more trouble?

i would still need to tell INS about that in the future even there is nothing, right?

Per PM: Go to your state's department of transportation (DPS) website and do it there. They all have a link were you can check it out for a fee. Let me know if you don't find it. That is the best place to check if the others are not giving results. Some private data bases buy records directly from counties or DPS. So checks there first let's see before you check the FBI. The FBI has its own system and I can't tell if they have all crimes or if it must meet a certain standard, or if you must have been finger printed. It is hard to know. SO you would know only by doing a BG check there.

No it would not cause any problem……….It is the right of anyone……..You would be okay. Even if it come up empty it is advisable to tell immigration the truth. It is hard to know………Sometimes it might come empty from the FBI but yet other immigration sources see it. SO play it safe because it would not hurt you even if immigration knows. We can't say with certainty if other law enforcement agencies would turn something to immigration during the BG check. SO play it safe.

And that is why after six weeks, over a misdomeanor. As if that's even looked for. Please.

Check now so you know if it is out there in the public and can be viewed by employers. But you should still expunge no matter what......Better play it safe............
 
hello mafioso

when the visa officer gets a hit does he or she get all the information along with it immediately, like the arrest details and the charges? I ordered a fbi check and my dui arrest shoes up there. then i contacted the arresting agency and got them send the disposition details (reckless driving ) to the fbi. according to them, they ran my info again and now it shows the disposition as reckless drivingl. will the visa officer now see both the charge and the disposition? Why do they have to wait few days for the clearance? What is it that they get from back here in the US?
 
I honestly can't tell with certainty why in most cases I am aware of, they keep people waiting. I guess it is just procedures set by the state department to confirm info first. But in some cases I have heard of, they don't wait.........So, I don't know why it is different for some people. If the system has been updated, it would show what they claim……..original charge and reduced charge…. Just make sure you handle your explanation of your DUI to reckless driving.........That would help them understand so it would not just sound like you were out trying to kill people. I hope it all goes well.......
 
The fines and possible effects on licenses, immigration, and employment on DUI charges are more severe. Reckless driving could be subjective to the cop who sites you. It is debatable because taking a turn fast without direction lights can be reckless driving. Many people can just look at it as if the cop was just being hard. But DUI shows very poor judgment and in most cases backed by BAC results and video. It has some element of proof. So reckless driving does not sound good either but is better in most cases. But for immigration purposes, reducing the charge to reckless driving might not change much because they view the original charge and all paper work........
