paypal screw up

I bought a film camera of ebay with buy it now for $2199 , paid instantly on a Thursday night.
On Saturday I send the seller a question if he was able to send the camera already. He promises that on Monday he would do so, since he was going to Europe for a trip. Monday than was Columbus Day in the us, means no us postoffice is open. That night I go back to to the camera listings, and look at this, the same camera is up for an 24 hr auction with the headline" buyer did not pay for the item, so I list it again" , my camera. I called paypal that evening, reported the act, and instead of freezing the transaction right on the spot, and call the police department, nope, they waited 2 weeks. I get back 200 bugs only.
6 weeks later- I have not heard from the guy, neither received the camera, neither is paypal taking any responsible for the failed action.
The seller even logs in and out of his website account;

Does anyone know if I have a case against paypal???
 
Did you buy the buyer protection?

Aparently not.

Did you pay for the camera with your paypal balance, or was it withdrawn from a credit card or bank account?

If it was from a credit card, you may try talking to your credit card provider about doing a chargeback. Paypal rarely takes the sellers side in a charge back, I would assume especially in this instance.

Hopefully you paid at least a good chunk of it with your CC and can get things worked out.

well, I always thought I would be protected like with the credit card companies, but nope. The seller was just with 200 bugs covered, thats all I got back. Also, paypal took $600 dollars from my checking account( $1600 was in in paypal account), for this deal. My bank told me , I gave paypal permission for this transaction, so , no money from this side.
I guess I learned the hard way. I sold one of my jazz guitars for the camera deal, that makes it so hard.

All I can say is --- owch!

That's a hard lesson to learn.

Yes, it hurts, bad, but it is unfortunately all in PP's policies. They'll take back what they can from the other's account, and try to reverse the rest from their bank account if one is attached, but short o that, without the buyer protection plan being bought, they're pretty much done.

Fortunately I learned this on a $90 purchase of hardware.

Though you could go after the seller in small claims. You know paypal has the details on who this person is, since he got the money from them somehow. But that area isn't my specialty so I'm going to have to leave off there.
 
I went through this recently. The scammer scribbled something as the return address on the box of trash he shipped me. When I contacted Paypal for an address so that I can sue him, they tell me they need to protect their scammers (not in those exact words), and that I would need have the court order a subpoena.
