claim against ebay seller

Hi

I am based in Sydney AU & had bought two readings from ebay US website last month but the readings were not delivered to me by email. I requested the seller many times but he told me that he'd sent me the readings by email. I then lodged a paypal dispute & a claim was escalated. Paypal were unable to resolve this claim in my favour because the item purchased was virtual or intangible. As a result, they did not taken any action against the seller. I complained to paypal & told them that I had made a similar purchase from ebay the earlier month & had filed a dispute when I did not receive the reading by email and paypal had resolved the claim in my favour & refunded me the money. They could not provide me with a valid explanation.
I want to know if I can take any legal action (small claims) against the ebay seller/paypal/ebay & could recover the money paid to him.

I feel your pain. There are more and more people among my friends who
got dropped by paypal. I lost $2200 in a deal, I saw that the seller listed the item for a second time. I called the Paypal retards , but they did not do anything,why do I have to pay for their stupidity?
They protect the thieves, not the buyers.

Paypal does not refund for virtual services.

When paying for physical goods, pay with your paypal account if you want to. But even this is a BAD BAD idea.

When paying for virtual goods, either accept that you could be throwing money away, or pay with a credit card.

Credit card reversals are generally much more consumer friendly than paypal reversals.

When in doubt, transfer your Paypal balance to your bank, and fund your purchase through paypal with your credit card (it's an option when going through the checkout system). This lets you try to resolve issues with paypal first, and if that doesn't work, you can always trump PP's decision with a CC reversal. I took a $90 lump on the head to learn this one once. :D

And really, by 'reading', I can only assume some form of 'psychic reading', yes? In that case, I'll give you a freebie in lieu of you stressing out about this more.
