Michael - you may find this page helpful as well: Terms of Sale - Microsoft Store

Basically, and to repeat what was said before, you have no case. It might be time to move on to greener pastures.

I'm guessing the OP might be the person on the left side of the picture and not the right side. More seriously, I really hope the OP isn't the person who is the subject of most of the search results when you google the name. That would be awfully embarrassing.

Yes no agreement at all n how can i examine a game that is download only from xbox market place
There are definitely agreements that unfortunately no one reads. It's not always the consumers fault since they are so unweildy but be rest assured they are almost certainly there.

tl:dr = If the company isn't providing you with a refund per a complaint that I haven't heard about then there isn't going to be an easy way to obtain a remedy. You may be best served having enjoyed the game, warn others if you wish about the perils of game saving, and move on.

The bottom line is this - lets even assume that the agreement has some vulnerability that would allow you to recover something. You've had enjoyment from the game and a part of your expectations were fulfilled. Essentially you're talking about something less than $50 damages - at best. You're free to file in small claims court that has jurisdiction or, as I mentioned above, you've got a choice of a class action and/or trying to reach a state attorney general. What you describe is, strictly in my opinion, a challenging case to bring in a civil court because I can't see where you have a clear cut wrong that is worth a specific dollar sum.

@Michael Wechsler - I don't believe the OP has any damages (which still falls within the "at best" umbrella). The OP received a license to use the software and agreed to the terms of service. The OP still has the access to the software, and has been utilizing it continuously since purchase with, apparently, no complaints about the functionality of the software. Furthermore, the incident that the OP is complaining about occurred 2 years ago, while his other complaints have to do with the fact that he doesn't like the current user-base and the direction the game has taken.
