Use of excessive force and injured

The Police Dept; charged me with resisting arrest and public intoxication. I had been asleep for about 4 hrs prior to that. I had come back from a party about 11pm when I was notified that my wife was being arrested. I walked down to the scene to ask the police to let me take my car home because the incident was 4 houses down from where we live. They would not let me take it , they wanted to tow it. The argument got heated and the officer did not like what i said and decided to arrest me.

I was force fully arrested by behind grabbed by the arm, getting twisted around and cut by the hand cuffs. I was pushed to the ground by 2 officers, then all of their weight on my neck and back. The 2 officers were not small guys by weight or size. They also tasered in the back and pepper sprayed me directly in the face while I was laying face down on the ground. I felt the spray nozzle next to me left eye. I think I was also hit in the left side of my temple at some point.
I have pictures of the injuries. I was also left with the spray all over my face and head for the next 24 hrs.
Now the base of my neck will not stop hurting. Like 4 to 5 vertebrae's down from the top of my neck
I do not have a court date yet. It happened Sunday 10/11 @ 0330

I had to spend the money I had to get my wife a lawyer for the dwi and the evading arrest charge.
I am looking for someone to help me with the injury portion of my arrest. I started to go to the chiropractor for the neck issue 10/14. It will take a while for it to get better.
I am asking for some type of help in this case.

Surely you know that the police officers will have a much different version of events that justifies their use of force.
That you were allegedly intoxicated is going to discredit your recollection. It is also a good reason why you were not allowed to take the vehicle.
You will likely have difficulty trying to prove the police officers acted unreasonably and with excessive force. If they were body cameras or if the incident was captured on a vehicle camera you may have opportunity to see the incident from a different point of view.
If you can not afford an attorney you will have to wait until you appear in court and ask for one to be appointed to you.

I suggest you abandon the chiropractor and seek medical attention from an MD or DO.

I also suggest you speak to several attorneys in your county that practice/specialize "personal injury" lawsuits.

If you have a solid case, and from what you posted, you appear to a solid case.

You should have no problem finding a good attorney willing to take your case on contingency.

What is contingency you ask?

The attorney will take about 1/3 of whatever settlement or award he/she can get for you.

You pay the attorney NOTHING out of your pocket.

See that physician, (MD or DO) immediately.

As far as any criminal charges pending against you, address that when you receive your court date.

That is simpler, because all you need to do is appear as ordered and plead not guilty.

At that time, you can also ask the court for a public defender (assuming you qualify financially).

If your finances disqualify you, you'll have to hire one yourself.

Whatever you do, don't discuss any aspect of the case, excpt with your lawyers.

In other words, its time to shut yoru mouth and wait silently.

If you start blabbing, you end up harming yourself.

am looking to have this type of behavior brought to light and I have been calling different attorneys. As of now I am waiting on call backs and I will see a medical professional on this injury. If I can not find a good attorney to represent me for this injury and the excessive force, i really do not know what else to do at this point. Hopefully I do find an attorney that can help with all of this. I came to this site to seek help from an attorney in my area inorder to get advise or help in proceeding forward with this issue.

Don't wait, make at least THREE appointments with "personal injury attorneys", then visit each one in person.

There are thousands of victims out there, seeking a good attorney to represent their interests.

There are also thousands of criminal defendants seeking the same thing.

Visit the attorneys, tell your story, keep it simple, don't make yourself look perfect, TELL THE TRUTH.

The incident happened FOUR days ago.

If you haven't been to the ER, go today.

Get examined, get a diagnosis, and start getting treated today.

Make sure you see an MD or a DO.

Posting on the message boards won't get you an attorney. There is a "Find a Lawyer" link at the bottom of every page.
 
You need a lawyer. I found the records of your arrest in Harris County along with your address, telephone numbers, and prior criminal record. It's a bad idea to post your personal details here.
