Hi Everyone.

I am based in Kenya where I have been following with keen interest on a serious Financial Scandal called the Triton Oil Scandal involving a sum of GBP 60M.

After a long 10 year battle to have the suspect extradited to Kenya from UK, the Court of Appeal in UK y'day (14/05/20) ruled that the suspect will be extradited to face trial.

My question.

For those who are familiar with the legal system in UK, is this the final ruling or can the defendant appeal to the Supreme Court ?

Thanks.

This site focuses on U.S. law, not law in the U.K. It is, however, my understanding that in extradition cases, the first decision is made by the Westminster Magistrate's Court. If the court orders the extradition, the case goes to the Home Office for a decision. If the Home Office approves the order, then the person may apply for appeal to the High Court. The High Court does not have to hear the appeal, however. After appeal to the High Court, an appeal may be made to the Supreme Court, and again the Supreme Court does not have to hear the appeal. There appears to be no role for the Court of Appeal in the extradition process under the Extradition Act. For more info on the UK extradition process, see the following from the UK government:

Thanks for the prompt update.

If the Court of Appeal has "no role" for the extradition process under the Extradition Act, as you say, why was the Ruling made by the Court of Appeal ?

This forum is NOT a UK law forum. You received a general overview by one of our American attorneys, but you will need to speak with a UK legal professional if you have specific questions.
