ROTC Disenrollment

I am being disenrolled from ROTC for failing a drug test. Please don't pass judgement, as I did not intentionally ingest this drug. I don't use drugs, and have been tested over a dozen times through my reserve until. This makes no difference as I messed up, and now face the consequences.

I am SMP and have a 4 year scholarship, and am in my last year. I have received my disenrollment packet and have to pay back over 125k. I am being told that I will not be able to chose active duty to repay due to the failed drug test.
Furthermore, once I am disenrolled I will be released to my PA NG until to face further action.

Does anyone know anything about this process? Am I able to serve active duty? Can I repay this debt through my PA NG contract? Any information would be appreciated.

Just curious... How did you accidentally ingest the drug? Did you have opportunity to explain this? Are you afforded any appeal process and has it been used?

Per a thread down the street OP unknowingly ingested THC laced food/drink. (clarify: knowingly ingested the food/drink, didn't know it was dosed. ;) )

Have you asked to speak to a JAG (legal) officer?

If not, I suggest you do so ASAP.

If seeing a JAG is not allowed or denied, I suggest you locate a civilian attorney that specializes in military matters.

You should also contact your US Congressperson and one of your US Senators and ask for help allowing you to be retested and remain in the program.

Once you've done as I suggested, return and report your findings.

You do have RIGHTS unless you foolishly waived said rights.

Per another thread on another site, THC was the drug.
 
Thank you for the information. I have been trying to get in touch with Jag, and am still waiting for them to appoint someone.


My PA NG Until seemed to be very supportive of my situation. They pulled my records and it showed that I have been tested numerous times (approx 12) since I enlisted.

I did not admit to anything, and have not responded yet (returned my Disenrollment packet) as i don't fully understand the wording. As much as paying back the money is an issue, I am more concerned with my Military Career and effect on my future in general.

My PMS appointed an Officer to help me understand my options, but I have yet to meet with them due to the COVID 19 situation.

Great, let me know when you hear something definitive.

As you surmised, the Chinese virus contagion will delay things.

If the substance was THC, have you contacted another laboratory to obtain your own test?

If you haven't, I suggest you begin that search tomorrow.

Your unit should be able to offer you some guidance in that regard.

Your NG unit should be able to offer you insight as to how a member can dispute a positive test result, if she/he has not indulged in illicit substances.

I'd be very careful about what you said or do until a JAG defense counsel has bene appointed to represent you.

Of course, it should go without saying, (I'll say it anyway) observe all military courtesies and protocols during the interim.

Additionally, neither admit or deny anything until you have obtained a defense counsel.

What you appear to be facing is some sort of chapter action, rather than a prosecution under the UCMJ.

Nevertheless, you still retain all rights of any US citizen and any and all rights pursuant to the UCMJ.
 
I had something like this crap happen to me as well. Except the drug was acid... They put it in my drink. I knew the 2 guys that did it.... It back fired on both of them badly as I beat the living shit out of them. Of course this was many years ago. My commander and first sgt were logical guys at the time as well. I know Army Judge will be saying " You did WHAT?".... I told both of them what had happened... Upon speaking the those 2 idiots. Plus I think seeing their faces badly bruised. Everything ended there.... In today military you need to follow what Army Judge stated.. Don't confess to anything.
