Need advice... 14 year old

My 14 year old son lives with his mother and 2 adult brothers(both in their 20's) in sparks Nevada. I live in yuba city California. I have visitation every 2 weekends, 2 weekends in a row plus alternated holidays and for weeks at a time in the summer. My son recently told me he wants to come live with me and he also told me he's been struggling with addiction to marijuana and vaping nicotine, he has stopped and says he wants to move with me to have a fresh start and also to stay clean. Since his two older brother use marijuana in the house where my son resides with he and his brothers.
I tried addressing my concerns with my sons mother but she was in denial that he was using any drugs or vaping. I want our son to be in a safe environment and not feel pressured to continue this lifestyle. Will my concerns and my sons choice to move based on what's going on give me cause to file an experte in my county while I have him in my custody ?
I haven't discussed his move with his mother yet but if she doesn't agree I want to be prepared and do what's best for our son.. what steps should I take other than the experte?
 
When your son is with you consider taking him to a counselor regarding his addiction. Having him speak with a professional about it could be helpful in the process, even if unsuccessful with the custody change.
Your son is old enough that s judge may consider his wishes. The opinion of an independent counselor could be even more helpful.

What state is the court order out of?
 
This is an issue best addressed in the court that gave custody ruling. In mean time you and Mom need to Co Parent as this will only get worse without help.

 
Not sure what "the experte" might mean, but the answer to your first question is yes. I suggest you consult with a family law attorney in the area of the court where your divorce judgment or custody order was issued.
 
By the way, I'm guessing that, when you wrote "experte," you meant "ex parte," but ex parte is an adjective; it's not something you can file.* You can seek to modify the existing judgment/order, but nothing you've written compels the conclusion that you have grounds to do so on an ex parte basis.

* - Ex parte has two unrelated meanings in the law. In this context, it refers to the procedure for having the court consider a motion on an expedited basis. In general, it requires a showing of of irreparable harm, immediate danger, or some statutory basis for granting relief on an expedited basis.
 
And just in case 'Jeniffer209' is not Dad but Dad's new girlfriend/wife, Dad will have to do this. You cannot do this at all. You are legally nobody in any matter between Dad, Mom, and their children.
